Terms of Use
These Terms are an agreement between you and Parviz Turabov (“Clearday”, “we”, “us”) for your use of the Clearday app. By using the app you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the app.
Clearday is a wellness and tracking tool. It is not a medical device and does not diagnose, treat, cure or prevent any disease. Scan results, “purging” or “breakout” reads, likely causes, routines and other suggestions are automated estimates that can be wrong. Always talk to a dermatologist or other qualified health professional about your skin, especially if your acne is severe, painful, scarring, or not improving, or if you are pregnant, breastfeeding or using prescription treatment. Stop using any product that causes burning, swelling or a rash. Never ignore professional advice or delay seeking it because of something in the app.
1. Who can use Clearday
You must be at least 13 (or 16 in the EEA and UK) years old, and if you are under the age of majority where you live, you must have a parent’s or guardian’s permission. You are responsible for keeping your device and account secure.
2. Your account and your content
You own the photos and information you add to Clearday (“your content”). You give us a limited, non-exclusive, worldwide, royalty-free license to store, process and analyze your content only as needed to provide the app to you, as described in the Privacy Policy. This license ends when you delete your content or account. You confirm that the photos you upload are of you, or that you have the right to upload them.
3. Subscriptions and payments
- Some features require a paid subscription (“Premium”). Prices and billing periods are shown in the app before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase.
- Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period at the then-current price.
- You can manage or cancel your subscription in your device’s Settings → [your name] → Subscriptions. Deleting the app or your Clearday account does not cancel a subscription.
- If a free trial is offered, any unused part of the trial is forfeited when you buy a subscription. If you don’t cancel before the trial ends, the subscription starts and you are charged.
- Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com.
4. Acceptable use
Don’t misuse Clearday. For example, don’t upload photos of other people without their consent, don’t upload illegal or sexually explicit content, don’t try to access other users’ data, and don’t reverse engineer, overload or interfere with the app or our servers, except where the law expressly allows it.
5. Accuracy and availability
The app relies on photos, lighting, your answers and third-party AI models, so results vary and may be inaccurate. We may change, suspend or discontinue features at any time. We don’t guarantee that the app will be uninterrupted or error-free.
6. Our intellectual property
The app, its design, text, graphics and software belong to us or our licensors. We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, under these Terms and the Usage Rules in Apple’s Media Services Terms.
7. Disclaimers
To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms limits rights you have under consumer laws that cannot be waived.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any skin reaction, health outcome or decision you make based on the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Some places don’t allow these limits, so they may not apply to you.
9. Ending these Terms
You can stop using Clearday and delete your account at any time in Settings. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections that by their nature should survive (such as disclaimers and limitation of liability) continue to apply.
10. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app (including product liability, legal or regulatory claims, or intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms are silent, Apple’s standard Licensed Application End User License Agreement applies.
11. Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law rules. If you are a consumer in the EEA or UK, you also benefit from the mandatory protections of the law of the country where you live, and you may bring claims in your local courts.
12. Changes
We may update these Terms. We will post the new version here and update the date above, and if the changes are significant we will tell you in the app. If you keep using the app after changes take effect, you accept the updated Terms.
